2. Scope of Services


ImportFromPoland PSA acts as a supplier and contracting party, not as a courier or shipping intermediary.

Clients purchase goods directly from ImportFromPoland PSA under one consolidated agreement. The Company is responsible for:

  • Supplier coordination and sourcing

  • Price negotiation and verification

  • Order consolidation

  • Quality control coordination

  • Organisation of insured delivery

  • Export documentation and paperwork

  • After-sales support, including warranty handling

3. Orders and Quotations



3.1 Quotations

All quotations are issued in writing via email or through the Company’s official quotation system.

Unless otherwise stated:

  • Quotes are valid for the period specified in the offer.

  • Prices may be subject to currency adjustments prior to payment.

  • Custom or made-to-measure items (e.g., windows, doors, balustrades, roofing systems) are individually calculated.


3.2 Order Confirmation

An order becomes binding only after:

  1. Written acceptance of the quotation by the Client, and

  2. Receipt of the agreed deposit or full payment (as specified in the offer).

No verbal agreements shall be binding unless confirmed in writing. 

4. Pricing and Payment


4.1 Pricing Structure

Prices provided by ImportFromPoland PSA may include:

  • Product cost

  • Service fee

  • Delivery cost

  • Insurance

  • VAT (where applicable)

  • Administrative and export handling

All applicable charges are clearly specified in the quotation. The Company operates on a transparent, all-inclusive pricing model unless explicitly stated otherwise.


4.2 Payment Terms

Payment terms are defined in each individual quotation. These may include:

  • Deposit payment prior to production or order placement

  • Balance payment prior to dispatch

  • Full advance payment for standard goods

Failure to meet payment deadlines may result in delays or cancellation. 

5. Delivery



5.1 Delivery Organisation

The Company organises delivery from Poland to the agreed destination address. Deliveries are insured unless otherwise specified.

Estimated delivery times are provided in good faith but remain indicative. Delays caused by manufacturers, transport providers, customs authorities, or force majeure are beyond the Company’s direct control.

It's the client's responsibility to ensure location access for an articulated lorry (unless otherwise agreed in advance) and means to unload the order (unless otherwise agreed in advance) 



5.2 Risk Transfer

Risk transfers to the Client upon delivery and acceptance of goods at the agreed destination.

The Client must inspect goods upon arrival and report any visible damage immediately on the delivery note and in writing within 24 hours.

For Consumer transactions, risk transfers to the Consumer when the goods are physically delivered to and received by the Consumer.

6. Made-to-Measure and Custom Products


Products manufactured to Client specifications (including but not limited to windows, doors, glass balustrades, roofing panels, bespoke furniture) are:

  • Non-returnable

  • Non-refundable once production has commenced

The Client bears full responsibility for the accuracy of measurements, specifications, drawings, and approvals provided.

Production begins only after written approval of technical drawings where applicable. 

7. Returns and Cancellations


 

7.1. Right of Withdrawal (Distance Sales)

 Where a contract is concluded at distance (e.g. via email or online communication), the Consumer has the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after:

  • The day on which the Consumer receives the goods, or

  • In the case of multiple goods delivered separately, the day the last item is received.

To exercise the right of withdrawal, the Consumer must inform ImportFromPoland PSA of the decision to withdraw by a clear written statement (e.g. email).


7.2. Effects of Withdrawal

If the Consumer withdraws:

  • All payments received (excluding additional delivery costs for non-standard delivery methods) will be refunded within 14 days of receiving the returned goods or proof of return.

  • The Consumer bears the direct cost of returning the goods unless otherwise agreed.

  • The Consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


7.3. Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the Consumer’s specifications

  • Clearly personalised or made-to-measure products

  • Custom-sized windows, doors, balustrades, roofing panels, bespoke furniture or any product manufactured based on approved drawings or measurements

By approving technical drawings or confirming production, the Consumer expressly acknowledges that the right of withdrawal no longer applies once production begins.

8. Warranty and After-Sales Support


All products are covered by the manufacturer’s warranty, subject to manufacturer terms.

ImportFromPoland PSA provides:

  • Warranty claim coordination

  • Communication with manufacturers

  • Assistance in replacement or resolution

The Company does not independently modify manufacturer warranty terms.

Improper installation, misuse, or failure to follow installation guidelines may void warranty.


Consumers benefit from a minimum 2-year legal guarantee under EU law.

If goods are not in conformity with the contract, the Consumer is entitled to:

  • Repair, or

  • Replacement, or

  • A proportionate price reduction, or

  • Contract termination (where legally applicable).

Nothing in these Terms limits mandatory statutory rights available to Consumers under applicable law.

9. Limitation of Liability


 

 The Company shall not be liable for:

  • Indirect or consequential damages

  • Loss of profit or business interruption

  • Delays caused by third-party manufacturers or transport providers

  • Incorrect measurements or specifications provided by the Client

Liability is limited to the value of the supplied goods under the relevant contract.

10. Client Responsibilities


 The Client is responsible for:

  • Verifying all technical specifications

  • Ensuring site readiness for delivery

  • Providing accurate delivery details

  • Organising unloading equipment where required

  • Ensuring compliance with local building regulations

11. Force Majure


The Company shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:

  • Natural disasters

  • War or political unrest

  • Government restrictions

  • Transport disruptions

  • Manufacturer production delays

12. Governing Law


These Terms of Sale are governed by the laws of Poland. 
However, if the Consumer resides in another EU Member State, mandatory consumer protection provisions of that country shall also apply where required by law.

Any disputes shall be subject to the jurisdiction of the competent Polish courts unless otherwise agreed in writing.


13. Amendments


 ImportFromPoland PSA reserves the right to update these Terms of Sale at any time. The applicable version shall be the one in force at the time of order confirmation.
